Argentine Filed a Case against USA before ICJ
Argentine seeks to institute proceedings against the USA before the international Court of Justice. It requests USA to accept the Court’s jurisdiction.
The Argentine Republic filed a case against the USA regarding a “Dispute concerning judicial decisions of the United States of America relating to the restructuring of the Argentine sovereign debt”.
The Argentine contends that the USA has committed violations of Argentine sovereignty and immunities and other related violations as a result of judicial decisions adopted by US tribunals concerning the restructuring of the Argentine public debt.
In accordance with Article 38, paragraph 5, of the Rules of Court, the Application by the Argentine has been transmitted to the USA Government. The Argentine Republic “seeks to found the jurisdiction of the Court on the basis of Article 38, paragraph 5, of the Rules of Court”. Under that Article: “When the applicant State proposes to found the jurisdiction of the Court upon a consent thereto yet to be given or manifested by the State against which such application is made, the application shall be transmitted to that State. It shall not however be entered in the General List, nor any action be taken in the proceedings, unless and until the State against which such application is made consents to the Court’s jurisdiction for the purposes of the case.” Here is the ICJ Press Release.
